  • Payment can only be requested by creditors once the estate is sorted out.

  • In some cases, it may be necessary to negotiate payments to avoid the loss of the home, if the property forms part of the estate and could be sold to pay the debts.

  • If it is clear that there is little or no money in the estate, it is important to write to the creditors and suggest that they stop "pursuing" the debt (i.e., write the debt off). 

  • A person is not liable to pay a debt out of their own income unless they signed the agreement as a joint borrower or guarantor.
