Generally it will be necessary to make a claim in the country where the accident took place although different rules apply in some situations (e.g., holidays).

If it is competent to make a claim in the person's own country then the Court may take account of local standards and regulations when determining whether or not the event at issue constituted an act of negligence or breach of contract.
